Welcome to TheLunchApp. These Terms of Service ("Terms") govern your use of the TheLunchApp website, mobile apps, and related services (together, the "Service"), operated by Turbojetscooters LLC ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under 18, you confirm that a parent or legal guardian agrees to these Terms on your behalf.
2. Your account
- You are responsible for keeping your login details secure and for all activity under your account.
- You agree to provide accurate information and to keep it up to date.
- Notify us promptly if you believe your account has been compromised.
3. Orders and payments
- Prices, menu items, and availability may change at any time.
- Payments are processed by our payment provider, Stripe. We do not store full card details.
- Placing an order is an offer to purchase; an order is confirmed once accepted by us or the relevant vendor.
4. Wallet and credits
If you add funds to your in-app wallet, those funds may be used to pay for orders within the Service. Wallet balances are not transferable, are not redeemable for cash unless required by law, and may be subject to additional terms shown at the time of top-up.
5. Cancellations and refunds
Cancellation and refund eligibility depends on the status of your order and the vendor's policy. Where an order has already been prepared or fulfilled, it may not be refundable. Contact us if you believe there is an error with your order.
6. Acceptable use
You agree not to misuse the Service, including by attempting to disrupt it, access it without authorization, submit false information, or use it for any unlawful purpose.
7. Intellectual property
The Service, including its content, branding, and software, is owned by us or our licensors and is protected by applicable laws. You may not copy, modify, or distribute it without our permission.
8. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and uninterrupted availability.
9. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.
10. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules.
